Horticulture New Zealand and Wonky Box Fruit and Vegetable Box Giveaway Terms and Conditions.

Promoter: This Horticulture New Zealand Limited (“HortNZ”) and Wonky Limited (“Wonky Box”) competition is promoted by HortNZ and located in New Zealand (“Competition”).

Eligibility: For the purposes of the Competition, an eligible participant (“Participant”) is an individual that:

• is a New Zealand resident
• lives within a non-rural post-code or can provide a non-rural address to HortNZ for delivery of the prize; and
• is not an employee, contractor, or supplier of HortNZ, Wonky Box, or an immediate family member of one of those individuals.

Competition Period: The Competition begins on 6 August 2024 and ends on 30 November 2024. Entries received outside of the indicated period will not be considered.

Entry Requirements: To enter, Participants must:

• Sign the pledge on the campaign page at https://www.hortnz.co.nz/taste-the-yakka;
• Provide HortNZ with their full name, email address, and contact number; and
• Limit entry to one per person.

Prize Details:

• The prize consists of one Wonky Box family-sized fruit and vegetable box per week for one year (“Prize”).
• The Prize is non-exchangeable, non-transferable, and cannot be redeemed for cash or other prizes. Subject to Wonky Box’s Terms and Conditions.
• Prizes are subject to stock availability. In the event that a Prize, or any part of a Prize becomes unavailable (for any reason), HortNZ reserves the right to limit entry, cancel or amend the Prize at its sole discretion.

Winner Selection:

• Winners will be selected randomly unless specified otherwise.
• The judges’ decision is final, and no correspondence will be entered into.
• HortNZ reserves the right to verify the validity of entries and the identification of participants.
• HortNZ reserves the right to exclude any person in participating in the Promotion on reasonable grounds.
• HortNZ reserves the right to disqualify any participant suspected of tampering with the entry process or for submitting an entry which is not in accordance with these terms and conditions, or Wonky Box’s Terms and Conditions.

Notification:

• Winners will be notified via the email address provided during entry.
• Winners must provide shipping details to HortNZ for a New Zealand, non-rural address (i.e. not located within a rural postcode) within two weeks of notification to claim their Prize. Failure to do so will result in disqualification and a redraw.

Competition Decision: HortNZ’s decision is final and binding on all Participants. Participants who are not winners will not receive any notification from HortNZ.

Promotional Activity: Winners may be required for, and contacted by, HortNZ in respect of, promotional activity and Winners agree to make themselves available to HortNZ for this purpose.

Emails and electronic communications: By entering the competition, you agree and consent to HortNZ and/or Wonky Box sending you electronic messages, including emails, related to the competition. You also consent to HortNZ sending you news, special offers, promotional material and information from HortNZ by email, text or other channels from time to time. Where required by the Unsolicited Electronic Messages Act 2007, emails will have an ‘unsubscribe’ option.

Privacy: HortNZ will manage any personal information provided in accordance with its privacy policy, details of which are available on our website here.

Competition Changes: HortNZ reserves the right at any time to modify or discontinue the competition without notice.

Fitness for purpose: HortNZ does not warrant that the Prize will meet the winner’s requirements or that it will be suitable for any particular purpose. For the avoidance of doubt, all implied conditions or warranties are excluded in so far as is permitted by law, including but not limited to, warranties of merchantability and fitness for purpose.

Liability: HortNZ is not responsible for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained relating to the Prize. HortNZ is also not responsible for any late, lost, incomplete, misdirected entries or technical failures, nor for any failure to receive entries due to transmission failures or technical failures of any kind.

Circumstances beyond our control: Where a Prize is being supplied by a third party, including but not limited to Wonky Box, HortNZ accepts no responsibility in respect of the provision of the Prize.

Meta: HortNZ fully release and hold Meta harmless from liability and acknowledge that the promotion is in no way sponsored, endorsed, administered by, or associated with Meta.

Acceptance of Terms: By entering this competition, you agree to be bound by these terms and conditions. If you do not agree to these terms and conditions, you may not enter into the Competition and you are not eligible to redeem the Prize. HortNZ reserves the right to amend these terms and conditions at any time.

Jurisdiction: These terms and conditions are governed by the laws of New Zealand.
